Filing Deadlines That Can Affect an Injury Claim in Arapahoe County, CO

Colorado uses different time limits for different types of claims, and if a person misses one, they can end a case no matter how strong the facts are. For most injury claims tied to the use of a motor vehicle, the state generally allows three years from the date of injury to file a lawsuit. That may sound like plenty of time, but medical treatment, insurance talks, and record gathering tend to use up more of it than people expect.

Shorter deadlines can apply when a public entity may be responsible, such as a claim that involves a government vehicle or a roadway defect. Colorado’s Governmental Immunity Act generally requires written notice within 182 days of discovering the injury, and if you miss that window, it can end a claim before it starts.

Insurance policies can also carry their own notice requirements, which are separate from the lawsuit deadline. Insurers may ask for statements, medical records, and bills early on. Gathering those records can take weeks, especially if treatment is ongoing, so waiting until a deadline is near can leave little time to evaluate a claim.

A car accident lawyer can track the deadlines that apply, send required notices, and review a policy for shorter time limits.
