What to Do After a Pedestrian Accident in Colorado

Colorado is an “at-fault” state, and pedestrian accidents often involve complex questions of right-of-way. Because pedestrians are highly vulnerable, injuries are typically severe, making it crucial to secure the local police department’s report and any available traffic camera footage.

Under Colorado’s “modified comparative negligence” rule, you can still recover damages even if you were partially at fault, as long as your responsibility is under 50%.

In Colorado, drivers are required to yield to pedestrians in marked crosswalks or at intersections (even unmarked ones).

If the accident occurred while the pedestrian was in a crosswalk with the signal, the driver’s liability is often clear. If the pedestrian was outside of a crosswalk, the case may involve more scrutiny regarding “comparative negligence.”

Because pedestrian injuries are often catastrophic, medical bills can pile up quickly. Many Colorado auto insurance policies include Med-Pay (Medical Payments) coverage.

Even though you were on foot, if you have your own auto insurance, your Med-Pay can often be used to pay for immediate hospital costs regardless of who was at fault. This is a necessary “first-stop” for coverage while the longer process of determining liability and seeking a settlement from the driver’s insurance plays out.

Legal guidance is also important after a pedestrian collision. A personal injury lawyer can explain how claims are typically handled, help organize documentation, and advise on communicating with insurance companies. Lawyers can also guide you on what compensation may be available, including medical bills, lost wages, or long-term care costs.
